Unitary patent: Bundestag approved the new system

20-12-UPC update-2-kolomOn 18 December 2020, the German Senate unanimously approved the new system for the unitary patent and the Unified Patent Court (UPC). Ratification by Germany now only requires the signature of the German President.

This development in Germany means that the unitary patent and the UPC are another step closer. There seems to be growing optimism in Europe that the system will now go ahead, i.e. that the administrative organisation will be set up in 2021, after which the first unitary patents can be granted in 2022. For an innovative Europe, this is a sign of hope during the coronavirus crisis.

New legal obstacles can still not be ruled out. For example, a possible complaint to the Federal Constitutional Court (Bundesverfassungsgericht) and problems surrounding Brexit could - possibly - still throw a spanner in the works.
